Custom End User License Agreement

This EULA is concluded between you and CK-Labs only, and not with Apple Inc. (Apple). CK-Labs, not Apple, is solely responsible for the Licensed Application and its content, subject to applicable law.

This EULA does not create usage rules that conflict with the Apple Media Services Terms and Conditions or the applicable App Store Usage Rules.

The Licensed Application is licensed, not sold. CK-Labs grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to use TycoonX on Apple-branded products that you own or control, as permitted by the applicable Apple Media Services Terms and App Store Usage Rules.

Where Apple’s Usage Rules permit Family Sharing, volume purchasing, or another Apple-supported access mechanism, the Licensed Application may also be accessed by eligible associated accounts in accordance with those rules.

Except where applicable law expressly permits otherwise, you may not copy, distribute, sell, rent, lease, sublicense, transfer, reverse engineer, decompile, disassemble, derive source code from, modify, create derivative works from, or commercially exploit the Licensed Application. You must not bypass security controls, entitlement checks, payment validation, rate limits, or access restrictions, or use unauthorized clients, bots, scripts, macros, exploits, forged receipts, or manipulated software to obtain unauthorized access or an unfair advantage.

Nothing in this section restricts rights that applicable law does not permit CK-Labs to restrict.

TycoonX is an entertainment and business/economic simulation game.

In-game money, Diamonds, shares, companies, property, products, inventory, rewards, rankings, statistics, and other virtual assets are fictional digital game elements. Unless mandatory law requires otherwise, they are not legal tender, bank deposits, securities, cryptocurrency, investments, stored-value money, or ownership interests in real-world assets, and they have no guaranteed cash value, exchange rate, resale value, purchasing power, or future utility.

Purchased Diamonds do not expire solely because time passes. Virtual value or entitlements created by fraud, refunds, chargebacks, invalid purchases, duplication, exploits, technical errors, replayed transactions, or similar invalid events may be corrected using reliable server, store, and payment records, subject to applicable law.

TycoonX may offer paid digital products including Diamonds, one-time 30-Day VIP, and limited-time Lifetime VIP.

30-Day VIP is a one-time, non-renewing entitlement unless the applicable purchase screen clearly states otherwise.

Lifetime VIP is a one-time digital entitlement that may be offered only during selected limited promotional sales windows. It is not guaranteed to remain continuously available or to return in the future. CK-Labs may end a genuine sales window, change the price for a later genuine sales window, or choose never to offer Lifetime VIP again, subject to applicable law and any specific offer already made to a consumer.

“Lifetime” means the commercial operating lifetime of the TycoonX Service for the purchasing account while TycoonX continues to be operated and made available. It does not mean the biological lifetime of the purchaser and does not guarantee that TycoonX will operate forever. Mandatory consumer remedies remain unaffected.

Prices, Diamond bundle quantities, VIP prices, regional prices, currencies, taxes, promotions, and availability may change for future purchases. Completed one-time purchases are not retroactively repriced merely because a later price changes. A later price decrease does not automatically create a refund, credit, price-match, additional Diamonds, or additional VIP time, and a later price increase does not create an additional charge on an already completed one-time purchase, except where mandatory law requires otherwise.

The final total price and currency shown by the applicable App Store purchase interface before confirmation govern a completed transaction, subject to mandatory law and lawful correction of obvious errors.

CK-Labs is solely responsible for providing maintenance and support services for the Licensed Application as specified by CK-Labs or as required by applicable law. Apple has no obligation whatsoever to provide maintenance or support services for TycoonX.

CK-Labs may provide updates, patches, security updates, compatibility updates, balancing changes, or replacement versions of TycoonX. Some updates may be required to continue using online functionality where reasonably necessary for security, compatibility, legal compliance, platform requirements, game integrity, or continued operation.

Where applicable law requires CK-Labs to provide or notify users about updates, including security updates, those obligations remain unaffected. CK-Labs may stop supporting obsolete versions where reasonably necessary, subject to applicable law.

CK-Labs is responsible for any applicable product warranties relating to the Licensed Application, whether expressly provided by CK-Labs or imposed by law, to the extent such warranties cannot lawfully be excluded.

If the Licensed Application fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, paid for the Licensed Application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Licensed Application.

Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure of the Licensed Application to conform to an applicable warranty are the responsibility of CK-Labs to the extent required by applicable law.

To the maximum extent permitted by applicable law, the Licensed Application and related online services are provided on an “as available” basis. CK-Labs does not guarantee uninterrupted, error-free, permanently available, latency-free, exploit-free, or maintenance-free operation.

Nothing in this EULA excludes statutory consumer guarantees, conformity rights, warranty rights, refund rights, price-reduction rights, termination rights, update rights, or other remedies that cannot lawfully be excluded.

CK-Labs, not Apple, is responsible for addressing claims by you or third parties relating to the Licensed Application or your possession or use of it. This includes, where applicable, product liability claims, claims that the Licensed Application fails to satisfy applicable legal or regulatory requirements, consumer-protection claims, privacy and data-protection claims, and claims concerning digital-product conformity or statutory consumer rights.

Apple is not responsible for addressing those claims except where Apple itself has obligations under applicable law.

TycoonX, its software, graphics, audiovisual elements, branding, game systems, interface, original content, and related intellectual property are owned by CK-Labs or its licensors, except for third-party materials used under applicable licenses.

If a third party claims that the Licensed Application or your possession or use of it infringes that third party’s intellectual-property rights, CK-Labs, not Apple, is responsible for investigating, defending, settling, and resolving that claim to the extent required by applicable law.

You may not remove or alter copyright, trademark, attribution, or other proprietary notices included with the Licensed Application.

TycoonX may include chat, profiles, artwork, music, books, comments, community posts, and other user-generated content or social features. You remain responsible for content you submit.

You must not use TycoonX to publish, upload, distribute, or communicate unlawful, fraudulent, threatening, hateful, seriously abusive, sexually exploitative, infringing, malicious, or otherwise prohibited content under the TycoonX Community Standards.

CK-Labs may moderate, restrict, remove, preserve, or review content and accounts where reasonably necessary for safety, legal compliance, platform requirements, fraud prevention, enforcement of the TycoonX rules, or protection of users and the Service. Mandatory rights relating to moderation decisions remain unaffected.

You must not hack, tamper with, attack, disrupt, overload, or interfere with TycoonX; exploit bugs or unintended behavior; use forged or manipulated purchase receipts; bypass payment or entitlement systems; manipulate regions, accounts, devices, or payment information to obtain unauthorized pricing or benefits; or use unauthorized bots, scripts, automation, modified clients, or similar tools.

CK-Labs may use reliable server records, Apple transaction records, audit logs, backups, and other authoritative evidence to investigate and correct invalid game state. Where reasonably necessary and legally permitted, affected transactions, balances, virtual items, rankings, rewards, entitlements, or other game state may be corrected or rolled back.

CK-Labs may warn, restrict, suspend, or terminate access to TycoonX for serious or repeated violations of this EULA or the TycoonX Terms, fraud, cheating, unlawful activity, security threats, payment abuse, severe community violations, or conduct that materially harms other users or the Service.

Temporary restrictions may be applied immediately where reasonably necessary to protect users, payments, infrastructure, or game integrity. Where required by applicable law, appropriate notice, reasons, remedies, or appeal opportunities will be provided.

Termination of an account does not eliminate rights or remedies that mandatory law requires CK-Labs to preserve.

TycoonX is an evolving online game. CK-Labs may improve, rebalance, replace, modify, add, remove, or discontinue gameplay mechanics, features, services, virtual items, economy parameters, interfaces, or third-party integrations for valid reasons including game balance, economy stability, security, legal compliance, platform requirements, technical limitations, abuse prevention, or evolution of the Service.

Where mandatory law regulates changes to continuously supplied digital products, CK-Labs will comply with applicable contractual-basis, valid-reason, no-additional-cost, notice, durable-medium, termination, refund, price-reduction, or other requirements.

CK-Labs may permanently discontinue TycoonX where permitted by law. Where legally required and reasonably practicable, advance notice will be provided. Virtual game assets do not automatically become redeemable for cash solely because TycoonX is discontinued. Mandatory consumer remedies remain unaffected.

TycoonX may use or connect to services provided by Apple and other third parties, including authentication, hosting, cloud, analytics, payment, moderation, and infrastructure providers.

You must comply with applicable third-party terms of agreement when using the Licensed Application, including applicable Apple Media Services Terms and App Store Usage Rules.

Availability or functionality may depend on third-party providers. CK-Labs may replace or discontinue third-party providers where reasonably necessary, subject to applicable law.

Use of personal data in connection with TycoonX is governed by the TycoonX Privacy Policy and applicable law.

Where personal data is shared with third parties, including payment processors, authentication providers, cloud providers, moderation services, or third-party AI services, CK-Labs will comply with applicable disclosure, legal-basis, consent, security, and platform requirements.

You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a country supporting terrorism, and that you are not listed on any United States Government list of prohibited or restricted parties.

You must also comply with applicable local laws when using TycoonX.

Nothing in this EULA excludes or limits liability where exclusion or limitation is prohibited by applicable law. In particular, nothing excludes liability for intentional misconduct, fraud, injury to life, body, or health where legally protected, mandatory product liability, or statutory consumer rights that cannot be waived.

To the maximum extent permitted by applicable law, CK-Labs is not liable for indirect, incidental, special, punitive, or consequential losses, lost profits, lost business opportunities, or losses caused solely by circumstances outside CK-Labs’ reasonable control.

Any limitation applies only to the extent permitted by the law applicable to the user.

CK-Labs may update this EULA where reasonably necessary because of changes in law, platform requirements, security needs, functionality, third-party providers, or operation of TycoonX.

Where applicable law requires advance notice, consent, a termination right, continued access to an unchanged version, or another remedy, CK-Labs will comply with those requirements. Changes will not retroactively remove mandatory rights relating to purchases already completed.

You and CK-Labs acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right, and will be deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.

This EULA governs the license to use the Apple-distributed TycoonX application. The TycoonX Terms of Service, Purchases & Refunds Policy, Privacy Policy, and Community Standards may also apply to the Service, transactions, community functions, or data processing.

If this EULA conflicts with a mandatory provision of applicable law, the mandatory provision controls. If any provision is held invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.
